I need a math answer from all smart people.Help.I need to get home to Mississippi while out on Workman's-comp.
Aug 19, 2007 by spice | Posted in Personal Finance
I live in Beaumont California and I am injured from my job out on workmans-comp.My check will be 60 percent of what I gross plus I work partime at Wal-Mart supercenter.I make $14.20 an hour at the job where I got injured.I will recieve about 60% of my take home pay from work-mans comp.I was told that my insurance from Liberty Mutural will compensate for my other jobs wages as well. The $14.20 an hour job pays me bi-weekly 40 plus hours.Wal-mart pays me $10.60 part time no more than 28 hours a week and they pay also bi-weekly.I no this is confusing but can someone give me an estimate of how much money I will be recieving from this Workmans-Comp claim.I finnally have two weeks off injured and want to see my family for the first time in 3 years.Help me sum this up please.
To respond to another answer given, no they're not "triple dipping". Liberty Mutual is the Work Comp company. The assumption is that they're TD from both jobs which would entitle him/her to temp disability benefits from lost wages from both jobs. As far as using that money to go on a vacation, that's their choice. That money is intended to pay for bills and such, but that's not to say they haven't done a good job saving money. I just don't know how their Work Comp doctor is going to issue the required report to Liberty Mutual every 45 days to keep their disability check going.
To answer the math question, since you were injured at the job with the higher rate of pay, you would add together what you grossed at both jobs, and take 2/3 of that (not 60%).
14.20 x 40 = 568
10.60 x 28 = 296.80
568 + 296.80 = 864.80
864.80 x 2/3 = $576.53 per week.

How can I take someone to court with no lawyer?
Jul 02, 2007 by PinUpGal | Posted in Law & Ethics
Heres the deal, my brother in law was staying in my home in Mississippi for 2 years. We had a contract in the begininning stating that he was responsible for ALL damages since he was only sending money to the mortgage company and I was making nothing. Recently he left without telling me, after I told him he had to resign the lease or get out, and everything was destroyed or gone. We had a $5000 pool that is missing, there were holes in every room, our new carpets were cut and had stuff all over them, all the windows were spray painted. Insurance won't help me and I come to find out that my house is in the process of foreclosure because he hasn't even been paying the mortgage. I would like to sue for how much we would have sold the house for plus a bit more because it was our home but no lawyers are willing to help me. How can I file a claim in the state of MS without a lawyer? I am losing everything because of these people and everyone is telling me there is nothing I can do.
Insurance did respond and after two months said they were not going to do anything. They found every reason in the book to not pay out and I have filed a claim with MS department of Insurance. I did get the letters of foreclosure and tried everything in my power to save the house but can not afford rent and the mortgage and can't get anyone to make my brother in law pay his past mortgage plus the month he moved out. I did keep up with it but he kept promising he would pay it as soon as he got his bonus and I kept listening like an idiot. I applied for HUD assistance but they advised me that because I can't live in the house (because it is not livable), they could not save it. I am not saying that I was not stupid to have trusted someone because they were family but it doesn't mean that they should get away with it.
I filed a police report but they filed it as a civil matter because we knew them and were allowing them to stay in the house. However I do have the report. I did that right away.
You need a lawyer BAD. If you can't afford one, there are government lawyers who can help you just need to look into that matter in your local government.
You can take someone to court without a lawyer but it's tough. I've done it in small claims court but that's too small for your needs. You need a full blown lawyer in a normal court.

COBRA leaves users little for food, rent - Greenville News
10.01.09
John Peeler always took comfort in the knowledge that if he ever lost his job he'd at least have health insurance for his family through a federal law known as COBRA. Intended to keep employees from losing their insurance along with their jobs, the Consolidated Omnibus Budget Reconciliation Act of 1985 allows people to keep their employer coverage for up to 18 months, so long as they pay the full premium. But when the 39-year-old father of three lost his job as an IT manager in November, he discovered that his $1,304 monthly unemployment check barely covered his $1,318 monthly premium, forcing him to choose between a home and food for his family, or health insurance. "I can either pay the mortgage and have groceries or pay COBRA and have nothing to eat and foreclose on the home," said Peeler, of Moore. "I haven't slept more than two hours a night since November worrying about all this." Turns out Peeler is typical in South Carolina, where the average unemployment payment equals the average COBRA family premium, according to new research from Families USA. Released Friday, the study concludes that COBRA insurance is so expensive that most just can't afford it.
